Hereinafter called Mare Owner and the Mare Owner does hereby agree to have the mare bred to Ancan True Colors under the following terms and conditions:
1.
The breeding fee shall be $1,250.00 and shall be paid by the Mare Owner
to the Stallion owner as follows:

a.
$500.00 paid as a booking fee upon execution of this contract.
b.
$750.00 paid upon arrival of the mare for breeding at Ancan Morgans or before any
shipment of transported semen.
2.
The following expenses are for
fresh cooled semen transport:
I.
There is a $250 deposit required for the shipping containers.
II.
A collection fee of $275.00 will be charged for each shipment, and paid
in advance by check provided by Mare Owner.
III.
Federal Express will be the designated carrier unless other arrangements
are made.
IV.
Whenever possible, carrier charges will be directly billed to Mare Owner
by carrier.
V.
When direct billing is not possible carrier charges will be paid by check
provided by Mare Owner.
VI.
A maximum of six days following the shipment of semen will be allowed for
the return of the container, after six days a late charge of $15.00 per day will
be charge, and when container is returned the late charge will be paid by check
by Mare Owner.
VII.
Mare Owner must return containers by way of next day Federal
Express.
VIII.
Ancan Morgans are responsible for delivery to the carrier only and
shall not be held responsible for any delays or damages beyond delivery to the
carrier.
IX. Ancan Morgans will assure that the semen, when collected and stored for shipping, has been tested and is sufficient quality for inseminating and impregnating the mare.
3.
The following pertains to mares
being brought to Ancan
Morgans for breeding:
I.
Mares care shall be at the rate of $9.00 per day or $15.00 per day for a
mare and foal. Mares bred AI will be billed directly by Ancan's Veterinarian. All mare care shall be paid monthly and shall be paid in full prior to
departure of mare.
II.
Ancan Morgans shall have the right to obtain all veterinary and
farrier services they believes to be required. All such veterinary and farrier
charges shall be paid monthly and prior to departure.
III. For mares brought to Ancan Morgans, the results of a current negative coggins test, a veterinarian’s certificate of clean uterine culture will need to be sent in writing prior to mare’s deliver to Ancan Morgans.
IV. Ancan Morgans shall exercise reasonable care for health and breeding of mare (and foal), for which Mare Owners will assume full financial responsibility.
V. Mare Owner agree to hold harmless and indemnify the Stallion Owner, and Agent, their employees, or anyone associated with, for any injury, death, loss, or damage to, or done by. Said mare (foal). Insurance for mare (and foal), if any, shall be the sole responsibility of the Mare Owner; the Mare Owner shall indemnify and hold the Stallion Owner and Agent harmless there from.
4. Upon arrival, or before any semen is shipped, the Mare Owner shall provide Agent written results of a uterine culture taken within 45 days prior to first shipment of semen and processed by a recognized laboratory. The designated veterinarian must examine the mare within 45 days prior to shipment of semen and certify in writing that the mare is free of infection and in good condition. Failure to conform to the above portion of this paragraph will completely nullify the contract; no semen will be shipped and all guarantees will be null and void.
5. Breeding fees paid are non-refundable. However, the Stallion Owner offers a live foal guarantee to the Mare Owner. A live foal is defined as one, which is able to stand and nurse. In the event that the mare does not produce a live foal following the first breeding season, the Mare Owner may rebreed at no additional breeding fee the following year. If ownership and fertility of stallion hasn't changed in the following years, and the mare still hasn't settled in foal, mare owner may continue to breed this mare to this stallion for 3 more years (for a total of 3 years trying). The last 3 years a re-booking fee of $250/per year will be required, as well as a yearly and current uterine biopsy report on the mare being bred. Clauses two through nine will still be applied. Substitution of mare is permissible only with the approval of the stallion owner. Should the above named mare prove to be barren, or abort, or should the foal be unable to stand and nurse, the Mare Owner must notify the stallion owner with a certificate signed by a licensed veterinarian so stating within 72 hours of the foal’s death of such other determination.
6. The breeding season for Ancan True Colors begins March 1 and ends July 30. If, for any reason, a mare must be bred after that date, special arrangements must be made. Every effort will be made to breed the mare as necessary.
7. Appended hereto and made an integral part hereof is a Mare Information Form, the completion and truth of which is an essential consideration of this contract.
8. This contract is signed by the respective parties hereto at the places and on the dates set forth below and constitutes the entire agreement between the parties and same may not be amended or modified, except by a mutual exchange of written instruments, nor may this contract or any rights or obligations hereunder be assigned without the prior written consent of both parties. In case of litigation all parties agree that Michigan will be the Forum State and Michigan Law will be applied to this contract.
